Representative cases

(I) Trademark Infringement and Unfair Competition Cases · Represented Google Inc. in a trademark infringement and unfair competition case against a technology company in Shenzhen. · Represented Volvo Corporation and Volvo Shanghai in a case involving trademark infringement and unfair competition against a film distribution company. · Represented Volvo Corporation in 9 cases (out of a series) involving trademark infringement and design patent infringement against a company in Jiangsu Province (securing a total of over RMB 4 million in damages). · Represented Duracell U.S. Operations, Inc. in two administrative litigation cases regarding trademark invalidation; in one of these cases, successfully assisted the client in having the plaintiff’s claims dismissed. · Represented the defendant—a company in Fujian—in a trademark infringement case brought by the plaintiff, FILA Sporting Goods Co., Ltd.; facing a claim for RMB 3 million in damages, actively gathered evidence and presented a defense, ultimately assisting the client in reaching a settlement agreement with the plaintiff involving a final payment of only RMB 600,000. (II) Administrative Litigation Cases Regarding Trademark Grant and Confirmation of Rights · Represented Google Inc. in over 10 administrative litigation cases regarding trademark grant and confirmation of rights. · Represented Procter & Gamble in 3 administrative litigation cases regarding trademark grant and confirmation of rights. · Represented Oracle International Corporation in 3 administrative litigation cases regarding trademark confirmation of rights. · Represented Sensient Colors LLC (a leading U.S. manufacturer of food colorants) in 1 administrative litigation case regarding trademark confirmation of rights. · Represented Elodie Details (a renowned Swedish company specializing in infant and toddler products) in 3 administrative litigation cases regarding trademark confirmation of rights. (III) Copyright Infringement Cases · Represented a state-owned bank in a copyright infringement case against an individual. · Represented the defendant—a Shanghai-based food company—in a copyright infringement case brought by the plaintiff, Spin Master Ltd. Faced with the plaintiff's claim for 5 million RMB in damages, we actively gathered evidence and presented a robust defense, ultimately assisting the company in reducing the compensation amount by 2.5 million RMB; the court of first instance ruled that 2.5 million RMB in compensation was payable (the case is currently in the second-instance appeal stage). (IV) Enforcement Cases Represented Volvo in applying for the enforcement of over 10 court judgments (successfully added the former legal representative—who had been replaced during the litigation proceedings—as a party to the enforcement process, and requested the court to impose enforcement measures against them, such as restrictions on high-value consumption). (V) Consumer Rights Protection and Product Liability Disputes · Represented Apple Beijing and Apple Shanghai in consumer rights protection cases involving individual plaintiffs. · Represented Shanghai Warrior Footwear Co., Ltd. in product liability disputes involving individual plaintiffs, successfully assisting the client in securing the dismissal of the plaintiffs' claims. (VI) Retainer Legal Services Provided retainer legal services to Yum! Brands (KFC, Pizza Hut) for nearly three years.
