Guozun Cathay Associates South Africa Office serves as the core hub of the firm’s global service network dedicated to deepening its presence in the African market. It was officially established in Johannesburg, the economic heart of South Africa, in May 2023.

 

This document sets out the official unified fee benchmark for the 2026 financial year issued by Guozun Cathay Associates South Africa Office. All quoted fees are exclusive of South African Value Added Tax (VAT), currently levied at the statutory standard rate of 15%. Settlement is available in three freely convertible currencies: South African Rand (ZAR), Renminbi (RMB) and US Dollar (USD). All fee rules strictly comply with the Attorneys Act 1979 of South Africa and the practice regulations and fee guidelines issued by the Law Society of South Africa.

 

Part 1: Compliant Pricing Models

In line with South African local practice regulatory requirements and the cross-border service conventions of Chinese-invested enterprises, the firm has adopted five standardised pricing models, fully compliant with South African judicial regulatory rules and prevailing international commercial legal service standards:

 

1.Fixed-fee pricing model

 

Applicable primarily to standardised basic legal matters where the workflow is uniform and workload can be accurately quantified in advance. The total service fee is fixed in full upon signing of the retainer, with no hidden additional charges throughout the engagement. It covers standardised service scenarios such as local South African commercial entity registration, basic compliance filings, and standard legal document drafting and processing.

 

2.Hourly charging model

 

Applicable to non-standardised services such as major cross-border investment projects, complex dispute resolution matters and customised specialist compliance advisory services. Fees are calculated based on actual chargeable working hours of lawyers, with detailed, traceable timesheets issued monthly. The entire service process is verifiable and subject to client oversight.

 

3.Tiered percentage fee model by matter value

 

Applicable to property-related legal matters such as cross-border mergers and acquisitions, asset transactions and large commercial claims. Fees are calculated at tiered rates based on the value of the matter or project, fully aligned with industry practice for high-end commercial legal services in South Africa.

 

4.Success/collection contingency fee model

 

Permitted within the framework of South African legal practice regulations, and applicable exclusively to debt collection, commercial recovery and tort claim matters. Fees are charged only upon successful resolution of the case and actual receipt of recovered funds. The maximum fee ratio shall not exceed 25% of the total amount actually recovered.

 

5.Annual corporate retainer service model Provides year-round, full-scope legal support for enterprises, with a fixed annual service fee.

 

Part 2: Hourly Fee Rates for Lawyers

 

All practising attorneys and advocates of Guozun Cathay Associates South Africa Office hold valid practising certificates issued by the Law Society of South Africa. The core team is familiar with the application of laws in both South Africa and China, and provides seamless bilingual (Chinese-English) services throughout the engagement. Senior partners hold multi-jurisdictional practising qualifications across Southern Africa and have over a decade of in-depth experience in core areas such as cross-border investment, international commerce, regulatory compliance and dispute resolution. The entire team operates under a tiered, differentiated pricing system.

 

2.1 Standard Hourly Fee Range for 2026

 

ZAR 1,800 – ZAR 5,800 per working hour, covering all levels of personnel: junior practising attorneys, mid-level specialist attorneys, senior partners, and cross-border experts from the Beijing headquarters. The final applicable rate will be determined comprehensively based on core factors including the complexity of the matter or project, fit with area of specialisation, urgency of service requirements and team configuration.

 

2.2 Supplementary Charging Rules

 

For work conducted outside South Africa (including other member states of the Southern African Development Community, SADC), a travel and fieldwork allowance of 25% to 50% shall be added.

For services initiated on an expedited basis within 48 hours, or work carried out on public holidays or outside standard working hours, a 50% expedited service surcharge shall apply.

For matters handled on a multi-jurisdictional basis across Southern Africa, the rate shall be increased by 20%.

For dedicated bilingual court support services, the rate shall be increased by 15%.

For specialist compliance matters in mining and energy, financial regulation and export control, the rate shall be increased by 10% to 20%.

Part 4: Key Factors Determining Legal Service Fees

 

1.Compliance complexity of cross-border services

 

For projects and matters involving concurrent application of Chinese and South African laws, cross-border evidence collection, coordination of multi-national parties, and simultaneous multi-regional services across Southern Africa, fees will be increased proportionally based on actual complexity.

 

2.Level of industry-specific expertise barrier

 

Fees for sectors with high professional barriers, such as mining and energy, infrastructure engineering, financial regulation and cross-border investment, are higher than those for basic civil and commercial legal services.

 

3.Matter and project handling complexity

 

Fees for major litigation and arbitration, complex cross-border enforcement, dedicated regulatory response and mass dispute resolution will be dynamically adjusted based on actual workload.

 

4.Urgency of service response

 

Expedited service instructions, and work carried out outside standard working hours or on public holidays, will incur an expedited service surcharge strictly in accordance with established standards, with no room for negotiation.

 

5.Service procurement and cooperation model

 

Bundled annual retainer cooperation can reduce overall service costs by 15% to 25% compared with single-service one-off procurement.

 

6.Dedicated service team configuration

 

Fees will be adjusted accordingly for matters handled by multi-disciplinary expert teams, with cross-border support from the Beijing headquarters, or with dedicated on-site bilingual (Chinese-English) teams.

 

7.Matter performance risk level

 

The fee percentage for contingency fee matters is directly linked to the likelihood of success, difficulty of recovery, service duration and geographical scope of enforcement.

 

Part 5: Third-Party Costs to Be Budgeted Separately

 

The following costs are separate from legal service fees and will be reimbursed at official South African standard rates or actual amounts incurred. Our firm does not charge any handling premium for these items:

 

1.Government official fees Including all official levies charged by relevant South African authorities, such as commercial entity registration fees, visa and permit application fees, court litigation fees, arbitration institution fees, IP application official fees, and industry business licence filing fees.

2.Notarisation and authentication fees Including fees for local South African notarisation, apostille authentication, and China-South Africa consular authentication, settled at official rates based on actual occurrence.

3.Professional translation fees Fees for Chinese-English translation of legal documents and court simultaneous interpretation services, settled per project or per word in accordance with South African translation industry standards.

4.Third-party expert service fees Fees for professional services such as forensic appraisal, industry expert consultation, third-party due diligence providers, and audit and valuation institutions, settled based on actual expenditure.

5.Field travel and subsistence expenses Transport, accommodation and fieldwork allowances incurred for work conducted within or outside South Africa, reimbursed against valid receipts.

6.Financial handling fees Bank-related fees arising from cross-border transfers and currency conversion shall be borne by the instructing party.

7.Other third-party costs Fees for services provided by other professional institutions such as compliance testing and background checks, settled based on actual commissioned expenditure.

 

Part 6: Important Notice

 

All fee standards set out in this document constitute the official benchmark reference prices for the 2026 financial year of Guozun Cathay Associates South Africa Office and do not constitute any legally binding offer of services. The final fee for all legal services shall be as agreed in the formal written retainer contract signed by both parties, taking into account the specific requirements of the instructing party, the actual circumstances of the matter, the scope of services and the complexity of the project.
