Guozun Cathay Associates’ Albania Office Collaborates with Headquarters to Handle a Transnational Criminal Defence Case: Successfully Assisting Family Visit and Securing Bail Ruling for the Client

Issuing Body: Guozun Cathay Associates, Albania Office

Date of Case Closure: 12 January 2026

Key Outcomes: We have fully established the compliance channel for cross-border authorisation, successfully facilitated an on-site family visit, and obtained an effective court bail ruling for a Chinese citizen detained on suspicion of the offence of organising prostitution, resulting in the client’s release from custody.

This case was jointly handled by the Albania Office of Guozun Cathay Associates and the transnational criminal defence team of the Beijing Headquarters. In strict compliance with Albanian criminal procedure rules and the China-Albania bilateral consular agreement, and drawing on Guozun’s global legal service network and local practice resources in Albania, we delivered a full-chain, compliant criminal defence and rights protection solution for Chinese citizens involved in criminal proceedings abroad and their families.

This case has been included in Guozun’s 2026 Library of Typical Transnational Criminal Defence Cases. Its case-handling model — “pre-positioning of dual authentication for cross-border authorisation + rapid liaison with local judicial authorities + collaborative defence by dual teams” — has been widely applied to the handling of criminal cases involving Chinese citizens in Southeast Europe.

I. Case Background and Authorisation Process

Mr. Wang, a Chinese national, was arrested and detained by local police in Albania on suspicion of organising prostitution while working in the country. His elder sister, Ms. Wang, who resides in China, was unfamiliar with Albanian criminal judicial procedures, unable to travel to Albania in person to complete the visit and defence authorisation, and lacked knowledge of overseas bail regulations. As a result, the process of safeguarding his rights was at a standstill.

On 15 October 2025, Ms. Wang was referred to the Albania Office via the Beijing Headquarters of Guozun Cathay Associates. Given three core challenges in the case — validity recognition of cross-border authorisation, approval of visits for overseas family members of detainees, and bail defence for foreign nationals — the Albania Office activated the China-Albania Transnational Criminal Emergency Collaboration Mechanism on the same day, and formed a dedicated case team together with the Beijing Headquarters. Comprising 2 locally practising criminal lawyers in Albania and 3 transnational criminal lawyers from the headquarters, the team is fully authorised to handle the visit application and bail defence in this case.

II. Full Process of China-Albania Joint Case Handling

This case adopts a standardised collaborative model: the Beijing Headquarters is responsible for cross-border authorisation compliance coordination and family communication, while the Albania Office takes charge of local judicial implementation and court defence. Written work records and verifiable outcomes are produced at every stage:

A. 15 October – 17 October 2025: Dual-Jurisdiction Compliance Assessment and Custody Information Verification

1.Beijing Headquarters: Completed preliminary verification of the principal’s identity, kinship and authorisation claims, issued the Cross-Border Authorisation Compliance Risk Assessment Report, clarified the procedures and document checklist for notarisation and authentication of power of attorney documents, explained the basic rules of Albanian criminal proceedings to the family, and aligned expectations for the case.

2.Albania Office: Leveraging local judicial cooperation channels, verified the client’s detention facility, alleged offence, detention period and case-handling authority within 2 working days, confirmed that the client was not subject to restrictions on meetings or authorisation rights, and removed pre-procedural barriers.

B. 18 October – 25 October 2025: Dual Authentication of Cross-Border Authorisation Documents and Filing of Agency Authority

1.Beijing Headquarters: Guided the principal through the entire process of domestic notarisation and consular authentication by the Ministry of Foreign Affairs of China for documents including the power of attorney and kinship certificate, and simultaneously checked the format and wording of documents to ensure full compliance with the acceptance standards of Albanian judicial authorities.

2.Albania Office: Completed consular authentication of documents with the Albanian Embassy and Consulate in China, simultaneously submitted agency filing materials to the local detention authority and court, completed judicial confirmation of the defence lawyer’s identity and agency authority, and cleared compliance obstacles for the initiation of subsequent procedures.

C. 26 October – 2 November 2025: First Meeting with the Client and Comprehensive Verification of Case Facts

1.Albania Office: Local defence lawyers completed the first meeting with the client within the statutory time limit, comprehensively verified case details, the client’s level of involvement in the alleged offence and his physical condition during detention, confirmed the client’s defence claims, and formally produced Meeting Minutes which were fed back to the headquarters.

2.Beijing Headquarters: Combined information from the meeting with statements from the family, sorted out the core disputed points of the case, preliminarily formulated the overall strategy for bail defence, updated the family on case progress and the client’s situation, and responded to the family’s concerns one by one.

D. 3 November – 17 December 2025: Submission of Visit Application and Preparation of Bail Plan

1.Albania Office: In accordance with the requirements of the Albanian Custody Execution Law, formally submitted the family visit application to the detention authority, and supplemented the application with a full set of authenticated kinship certificates and identity documents. In line with statutory bail requirements, the office collated evidentiary materials including the client’s clean criminal record, stable social ties in Albania and eligibility for surety, and drafted the bail application.

2.Beijing Headquarters: Drawing on China’s criminal procedure practice experience and combined with Albanian local adjudication rules, optimised the logic of bail defence, focused on strengthening the argument of “no social dangerousness”, and formed a complete framework of defence opinions for the bail hearing.

E. 18 December 2025 – 10 January 2026: Bail Hearing and Court Ruling

1.Albania Office: The appointed lawyer attended the bail hearing, presented defence opinions in court, fully argued that the client posed no risk of absconding or interfering with evidence and met the conditions for bail, and responded to judges’ enquiries on site.

2.Beijing Headquarters: Remotely followed the entire hearing process, adjusted supplementary defence opinions in real time based on the court situation, updated the family on hearing developments, and provided procedural explanations and emotional reassurance.

On 10 January 2026, the local Albanian court formally issued an effective ruling granting bail to the client.

F. 11 January – 12 January 2026: Completion of Bail Formalities and Implementation of Family Visit

1.Albania Office: Assisted the client in completing bail formalities and securing release from detention, simultaneously explained the regulatory requirements and statutory obligations during the bail period to the client; accompanied the family throughout the official visit to ensure the process was compliant and smooth.

2.Beijing Headquarters: Delivered the Interim Case Closure Report to the principal, outlined the follow-up case trajectory and precautions, and answered the family’s questions about subsequent litigation procedures.

III. Core Case-Handling Difficulties and Authoritative Solutions

The difficulties encountered in this case represent common issues faced by Chinese nationals involved in criminal cases in Albania. The China-Albania joint team, with dual-jurisdiction professional expertise and local practical experience, has developed a replicable standardised solution:

A. Validity Recognition of Cross-Border Authorisation

Legal Basis: Article 36 of the Vienna Convention on Consular Relations, the China-Albania Bilateral Consular Agreement, Article 190 of the Albanian Code of Criminal Procedure

Solution: Adopt a full-chain compliance model of “domestic notarisation + dual consular authentication + local judicial filing”, prepare authorisation documents in strict accordance with the requirements of Albanian judicial authorities, proactively prevent procedural delays caused by document defects, and ensure that the agency authority is fully legally effective locally.

B. Procedural Approval Barriers for Overseas Family Visits

Legal Basis: Relevant provisions of the Albanian Custody Execution Law on visits by next of kin of detainees

Solution: Prepare dual-authenticated kinship certificates, identity documents and statement of visit purpose in advance, take the initiative to liaise with the approval department of the detention authority, and complete all required materials upfront. Compared with applications filed by overseas families on their own, the approval cycle is shortened by nearly 60%.

C. Breakthrough in Bail Application for Prostitution-Related Offences

Legal Basis: Articles 22 and 225 of the Albanian Code of Criminal Procedure

Solution: In response to the detention inclination of Albanian judicial authorities for offences of organising prostitution, build a defence system from dimensions including the client’s clean criminal record, stable residence and social ties in the local area, sufficient surety capacity and clear willingness to cooperate with the investigation, so as to mitigate the finding of “social dangerousness”, which was ultimately accepted by the court.

D. Adaptation to Cognitive Differences Between Chinese and Albanian Criminal Procedures

Legal Basis: Rules on compulsory measures in criminal proceedings of China and Albania

Solution: Throughout the case handling process, explain to the family the differences between the Albanian bail system and China’s bail pending trial system, including applicant subjects, forms of surety, review standards and regulatory requirements, correct cognitive deviations, ensure that the defence strategy is consistent with the family’s expectations, and guarantee the efficiency of procedural advancement.

IV. Authoritative Legal Basis Applicable to This Case

A. International Conventions and Bilateral Agreements

1.Article 36 of the Vienna Convention on Consular Relations: When a national of a Contracting State is arrested or detained in the territory of another Contracting State, he shall have the right to communicate with the consular authorities of his own country, and his next of kin shall have the right to instruct a lawyer to provide legal assistance.

2.Relevant provisions of the China-Albania Bilateral Consular Agreement: Where nationals of either Party are detained in the territory of the other Party, consular officials and instructed lawyers may conduct meetings, visits and other work in accordance with regulations.

B. Albanian Legislation

1.Article 190 of the Albanian Code of Criminal Procedure: A defendant shall have the right to instruct a defence lawyer from the date of detention; a defence lawyer shall have the right to meet with the detained client within 48 hours.

2.Article 22 of the Albanian Code of Criminal Procedure: The court may, upon application by the defendant or his defence lawyer, order the application of non-custodial compulsory measures such as bail; bail may take statutory forms including surety guarantee and property guarantee.

3.Article 225 of the Albanian Code of Criminal Procedure: Bail review takes social dangerousness as the core criterion, comprehensively considers factors such as the circumstances of the offence, the defendant’s criminal record, fixed residence and economic situation, and may grant bail where there is no risk of absconding or evidence destruction.

4.Relevant provisions of the Albanian Custody Execution Law: Next of kin of a detainee may apply for a visit with valid identity documents and kinship certificates, and may meet in accordance with regulations after approval by the detention authority; for overseas family members applying for a visit, additional notarised and authenticated identity and relationship documents shall be submitted.

C. China’s Foreign-Related Legal Rules

1.Relevant provisions of the Law of the People’s Republic of China on the Application of Law for Foreign-Related Civil Relations: The law of the place where the agency act is performed shall apply to authorised agency.

2.Relevant work specifications for China’s consular protection: When Chinese citizens encounter detention and other situations abroad, they may safeguard their legitimate rights and interests in accordance with the law by connecting domestic lawyers with overseas legal service resources.

V. Authoritative Practical Recommendations Based on Case Experience

Drawing on years of experience in transnational criminal legal services in Southeast Europe from the Albania Office of Guozun Cathay Associates, the following three practical recommendations are put forward for Chinese nationals and their families working or doing business in Albania:

1.Pre-emptive Compliance Preparation: Chinese nationals who work and live in Albania long-term may retain contact details of local legal service institutions in advance and familiarise themselves with basic local criminal justice rules; family members may complete kinship notarisation in advance, so as to swiftly initiate cross-border authorisation in the event of an emergency.

2.Timely Intervention for Rights Protection: The golden intervention window for overseas criminal cases is 72 hours after detention. Family members should instruct a lawyer team with dual-jurisdiction service capabilities as soon as possible, to avoid missing the optimal timing for meetings and bail due to unfamiliarity with procedures.

3.Pre-positioning of Procedural Awareness: Never assume overseas procedures follow domestic criminal litigation rules. Procedures such as bail and visits must comply with local legal requirements. It is advisable to advance the process under the guidance of professional lawyers, to avoid obstacles to rights protection caused by document defects or cognitive deviations.
