Guozun Cathay Associates Kenya Office Releases 2026 Legal Service Fee Standards

Officially launched in July 2025 in the central business district of Nairobi, the capital of the Republic of Kenya, Guozun Cathay Associates Kenya Office serves as a core institution for the firm to expand its African legal service network and support the Belt and Road Initiative. It also functions as the regional hub serving Chinese enterprises entering East Africa and developing China-Kenya cross-border business.

 

This document sets out the official unified fee schedule of Guozun Cathay Associates Kenya Office for 2026. All quoted fees are exclusive of value-added tax (the prevailing VAT rate in Kenya is 16%). Settlement is available in three freely convertible currencies: Kenyan Shilling (KES), Renminbi (CNY) and United States Dollar (USD).

 

Part 1: Authorised Fee Models

 

The firm strictly adheres to the Advocates Act of Kenya and the practice rules and fee guidelines of the Law Society of Kenya. Tailored to the cross-border service practices of Chinese enterprises, five standardised fee models are adopted, fully compliant with Kenyan judicial regulations and international commercial service standards:

 

1.Fixed Fee Model

 

Applicable to basic legal services with standardised procedures and accurately quantifiable workload. The total fee is fixed upon engagement with no subsequent add-ons. It covers standardised matters including commercial entity registration, basic compliance filing, standard document processing, and visa and permit agency services.

 

2.Hourly Rate Model

 

Applicable to major cross-border projects, complex dispute cases, customised compliance advisory, and industry-specific legal services. Fees are charged based on chargeable working hours of lawyers, with detailed monthly time sheets provided for full verification and traceability throughout the mandate.

 

3.Percentage of Transaction Value Model

 

Applicable to property-related matters including cross-border mergers and acquisitions, asset transactions and large-scale commercial claims. Fees are charged on a tiered basis by reference to the transaction value, in line with prevailing practice for high-end commercial legal services in Kenya.

 

4.Conditional Fee Model

 

Within the framework of Kenyan legal practice regulations, this model applies solely to debt recovery, commercial recourse and tort claim cases. Fees are payable only upon successful recovery or successful outcome of proceedings, with the fee ratio not exceeding 30% of the actual amount recovered.

 

5.Annual Retainer Model

 

Provides enterprises with annual full-scope legal support for a fixed annual service fee. A dedicated bilingual (Chinese-English) team is assigned with 48-hour priority response, covering full-dimensional compliance and risk management for daily business operations.

 

Part 2: Hourly Rate Standards

 

All lawyers at Guozun Cathay Associates Kenya Office hold valid practising certificates issued by the Law Society of Kenya. The core team is proficient in the application of both Chinese and Kenyan law, with seamless bilingual service capability. Senior partners hold multi-jurisdictional practising qualifications across the Commonwealth, with deep expertise in core areas including cross-border investment, international commerce, compliance regulation and infrastructure development. A tiered pricing system is implemented.

 

2026 unified hourly rate range: KES 12,000 – KES 45,000 per hour, covering all levels from junior practising lawyers, intermediate specialist lawyers, senior partners to cross-border experts from the Beijing Headquarters. The final rate is determined having regard to case complexity, professional specialisation, project urgency and team configuration.

 

Additional Billing Rules

 

20%–40% travel and fieldwork allowance for matters conducted outside Kenya but within the East African Community (EAC);

40%–60% travel and fieldwork allowance for cross-border matters conducted outside the East African Community;

50% urgent surcharge for 48-hour urgent response and matters handled on public holidays;

20% rate uplift for cross-border multi-jurisdictional collaborative matters in East Africa;

15% rate uplift for exclusive bilingual court hearing services;

10%–25% rate uplift for specialist compliance matters in financial regulation, mineral resources and energy, and infrastructure development.

 

Part 3: Fee Standards for Core Practice Areas

 

This schedule focuses on the core practice areas of Guozun Cathay Associates Kenya Office, tailored to the essential needs of Chinese enterprises investing and operating in Kenya and East Africa, and aligned with the requirements of relevant Kenyan regulatory authorities. All services are fully adapted to the Kenyan local legal system, as set out below:

 

3.1 China-Kenya Cross-border Investment and Market Access Legal Services

Fee range: KES 8,000 – KES 380,000

 

(a) Special due diligence and professional analysis of the investment environment, industrial policies and market access rules in Kenya and the East African region;

(b) Full-process agency for the establishment of various market entities (private limited companies, representative offices, branches, partnerships, etc.) for Chinese enterprises in Kenya, including foreign investment access compliance screening;

(c) Full-process agency services for enterprise operation qualifications, industry permits, administrative approvals and project filing in Kenya;

(d) Compliance design of foreign cross-border investment structures, and scheme planning and implementation for investment models including greenfield investment, cross-border mergers and acquisitions, joint ventures and equity restructuring;

(e) Full-process coordination and compliance review for industrial park settlement, industrial land and commercial property lease / acquisition;

(f) Special legal services for exit procedures, including enterprise equity restructuring, qualification variation, entity ongoing compliance maintenance, and deregistration, liquidation, equity transfer and asset disposal of foreign-funded enterprises.

 

3.2 Enterprise Full-cycle Compliance and Risk Control Legal Services

Fee range: KES 15,000 – KES 650,000

 

(a) Establishment of localised compliance systems for foreign-funded enterprises in Kenya, regular compliance inspections and risk early warning mechanism;

(b) Specialised Kenyan tax and foreign exchange compliance services, including full-cycle tax planning, daily tax filing compliance, tax audit response and tax dispute resolution; transfer pricing compliance and cross-border tax risk management; compliance scheme design and processing for foreign exchange account opening, cross-border fund remittance and profit repatriation;

(c) Full-process Kenyan labour and employment compliance services, including localised drafting and review of employment contracts and internal policies; compliance advisory on employee recruitment, social security contributions and statutory benefits; labour dispute prevention, mediation and litigation representation; compliance scheme design for economic redundancies and employee dismissal; local trade union liaison and labour compliance training;

(d) Compliance review under the Data Protection Act of Kenya, enterprise data governance, cross-border data transfer compliance schemes, and personal information protection system establishment;

(e) Full-chain compliance for Kenyan import and export trade, including customs declaration, tariff planning, trade control compliance, and anti-dumping and countervailing investigation response;

(f) Establishment and optimisation of enterprise internal control systems in Kenya, and specialist commercial bribery and anti-corruption compliance services.

 

3.3 Key Industry-specific Legal Services

Fee range: KES 22,000 – KES 820,000

 

(a) Infrastructure and Engineering Construction: project initiation, tendering and bidding, and full construction-process compliance; EPC contract review and risk management; engineering variation, claim and dispute resolution; project completion acceptance and delivery compliance;

(b) Mineral Resources and Energy: mining right application, renewal and transfer compliance; full-process legal services for mineral exploration and development projects; investment, financing, construction and operation compliance for energy projects;

(c) Agriculture and Food Industry: agricultural project investment, land lease and transfer compliance; agricultural product cross-border trade, agricultural inputs and food production and operation compliance; food quality and safety and geographical indication protection;

(d) Manufacturing and Cross-border E-commerce: factory establishment and production permit compliance; supply chain legal risk prevention and control; cross-border e-commerce platform compliance, logistics and payment legal services;

(e) Financial and Capital Markets: cross-border investment and financing, bank credit, financial leasing legal services; pre-listing and pre-bond issuance guidance for enterprises; private equity fund establishment and operation compliance;

(f) Tourism and Services: hotel and scenic spot investment and construction compliance; tourism service contract review; travel agency and tour guide management compliance.

 

3.4 Full-chain Intellectual Property Legal Services

Fee range: KES 3,000 – KES 320,000

 

(a) Full-process agency for registration, renewal, variation, licensing and assignment of trademarks, patents, copyrights, trade secrets and geographical indications in Kenya and the East African region;

(b) Full-process services for intellectual property due diligence, infringement monitoring and investigation, administrative complaints and enforcement litigation;

(c) Enterprise brand compliance management and intellectual property risk prevention system establishment;

(d) Specialist cross-border intellectual property portfolio and protection services in the East African region;

(e) Cross-border brand counterfeiting and domain name dispute resolution, trade secret protection and non-compete compliance implementation.

 

3.5 Cross-border Dispute Resolution and Rights Protection Legal Services

Fee range: KES 18,000 – KES 5,200,000

 

(a) Full-process representation in mediation and litigation at all levels of Kenyan courts for civil and commercial cases including China-Kenya commercial contract disputes, investment rights disputes, property disputes and creditor-debt disputes;

(b) Full-process mediation, arbitration and litigation representation for specialist disputes including labour disputes, intellectual property disputes and tax disputes;

(c) Cross-border commercial arbitration and mediation services, with full-case representation for proceedings before Kenyan and leading international arbitration institutions;

(d) Cross-border recognition and enforcement of Chinese and Kenyan court judgments and arbitral awards, and specialist cross-border asset preservation services;

(e) Cross-border debt recovery and arrears collection, full-process agency for Kenyan local enforcement procedures;

(f) Enterprise crisis communications and legal risk emergency response, specialist services for administrative disputes and commercial infringement disputes.

 

Special Note: For major cross-border economic crimes, transnational financial violations and serious criminal cases, there is no fixed fee cap. Fees are customised based on case complexity, scale of cross-border collaboration and evidence collection costs.

 

3.6 Cross-border Personnel Mobility and Supporting Family & Commercial Legal Services

Fee range: KES 5,000 – KES 480,000

 

(a) Full-process compliance agency for application, renewal and variation of business visas, work permits, residence permits and permanent residence;

(b) Mobility compliance management for enterprise expatriates and cross-border business personnel, specialist services for entry-exit related administrative reconsideration and dispute resolution;

(c) Compliance review of real estate acquisition and lease for foreign nationals in Kenya, and legal risk control for asset transactions;

(d) Wealth management, family trust, estate planning, family disputes and property division legal advisory and dispute resolution representation for cross-border high-net-worth individuals;

(e) Personal commercial compliance advisory, cross-border asset allocation legal risk screening and compliance guidance.

 

Part 4: Key Factors Affecting Legal Fees

 

1.Cross-border compliance complexity: Fees for matters involving dual application of Chinese and Kenyan law, cross-border evidence collection, multi-party collaboration and multi-regional coordination in East Africa will be uplifted according to the level of complexity.

2.Industry professional barriers: Fees for highly specialised sectors including mineral resources and energy, infrastructure development, financial regulation and cross-border investment are higher than basic civil and commercial legal services.

3.Case handling difficulty: Fees for matters including major litigation and arbitration, complex cross-border enforcement, special regulatory response and group dispute resolution are subject to dynamic adjustment.

4.Service urgency: Urgent instruction and holiday working will strictly attract an urgent surcharge in accordance with the standards, with no scope for negotiation.

5.Cooperation procurement model: Annual legal retainer packages offer an overall cost reduction of 15%–25% compared with individual service instructions.

6.Service team configuration: Fees are adjusted accordingly for matters handled by joint panels of experts, headquarters cross-border support, dedicated bilingual teams and Commonwealth multi-jurisdictional expert support.

7.Case performance risk: The fee ratio for conditional fee matters is directly linked to the prospects of success, difficulty of recovery, service duration and cross-border enforcement costs.

 

Part 5: Additional Third-party Fees (Reimbursable)

 

The following fees are separate from legal service fees and are reimbursed at official Kenyan rates or actual expenditure. The firm does not charge any agency markup:

 

1.Government fees: Official charges levied by Kenyan authorities, including commercial entity registration fees, visa and permit application fees, court filing fees, arbitration fees, intellectual property official fees and industry permit filing fees.

2.Notarisation and authentication fees: Kenyan local notarisation and Hague Apostille; China-Kenya consular authentication is charged at official rates.

3.Professional translation fees: Chinese-English translation of legal documents and court simultaneous interpretation, charged per document / per word in accordance with Kenyan industry standards.

4.Expert service fees: Judicial appraisal, industry expert consulting and third-party due diligence fees, reimbursed at actual cost.

5.Field travel expenses: Transportation, accommodation and fieldwork allowances for matters conducted inside and outside Kenya, reimbursed against valid vouchers.

6.Financial charges: Bank fees arising from cross-border transfers and currency conversion are borne by the instructing party.

7.Other third-party fees: Fees of professional institutions including auditing, valuation, compliance testing and land surveying, reimbursed at actual cost as instructed.

All fee standards contained in this document are official benchmark reference prices for 2026 and do not constitute a binding offer for services. The final fee for all legal services shall be determined by the written engagement contract signed by both parties, having regard to the client’s specific requirements, the actual circumstances of the matter, the scope of services and the complexity of the project.
